Bike Shop Ruined my New Carbon Frame

Hi Everyone, I need a sanity check. Am I right to be as upset as I am about this or am I being unreasonable? I purchased a new Jamis Renegade C2 from a local bike shop. While in the shop the seller recommended I put 43" Gravelking SK tires on it. I went with his expert recommendation and they installed it in shop. After my second bike ride I noticed the rear tire rubbing against the frame. I took it to another shop down the street from me to have the wheels trued so I could continue on my third ride with this bike. The new shop said the wheel was only slightly out of True, but the tires were way too big for the frame and they showed me a .9mm gouge through the paint into the frame. Sure enough Jamis' Website states that the carbon frame Renegade accepts up to 37mm tires. I contacted the seller and they refused to accept any responsibility for it, no apology and only offered an epoxy patch. I don't like confrontation and I don't like to argue, but am I wrong in thinking that the only way to make this right would be to order me a new carbon frame? Additionally, After being in the shop for 3-days I called to get a timeline for the repair and got a condescending, dismissive response with no commitment to when I would get the bike back. I like to support local businesses and value building 1-on-1 relationships with them, so I hesitate to post negative feedback, but at the same time I feel like their probably honest mistake is expensive mistake for me and I don't see any remorse or commitment to taking responsibility for that mistake. I just had my biggest crash

Paved trail, simple long ride on a beautiful day only to hit some mud, bike slides out and down I go. Hurt but was able to ride back to my truck, so far minimal damage to my bike, bars no longer centered to the tire being the worst. Trip to the ER to find I broke my collar bone when I landed on my shoulder. 4 cm overlapped so I'm getting a plate put in on Monday. If I'm going to crash I'm gonna make it worthwhile.
